TrendingUP: Creating for a Cause Event Participation Agreement and Release (“Agreement”)
By attending and/or or participating in TRENDINGUP: Creating for a Cause (the “Event”) sponsored by the Hub Project a project of the Sixteen Thirty Fund (“Sponsor”), You agree as follows:
Attendance
You acknowledge that Your attendance at or participation in this Event is granted solely at Sponsor’s discretion. Registration benefits and access to Events are limited to the individuals named in the registration form and are non-transferable, except as permitted by Sponsor. You acknowledge and understand that when You agree to attend the Event, Sponsor will incur personal travel and lodging costs for Your benefit, which may be non-refundable. Your failure to attend the Event for reasons other than illness, travel delay, weather, or other such situations beyond Your reasonable control may result in Sponsor seeking reimbursement for any such non-refundable personal travel and lodging costs incurred by Sponsor for Your benefit.
Event Code of Conduct
To help provide a safe and productive environment for the Event, this Event Code of Conduct (“Code”) establishes minimum expectations of behavior for all individuals (including attendees, speakers, sponsors, staff, contractors, volunteers, organizers, and other guests, collectively referred to as “Participants”) who attend or participate in any manner in the Event.
By attending the Event, you agree to abide by this Code.
Expected Conduct and Prohibited Behavior
We invite you to help us make each Event a function that is welcoming and respectful to all Participants. Participants are expected to conduct themselves in a professional manner, to communicate with respect and consideration for others, to encourage collaboration and participation, to embrace diversity and inclusivity, and to refrain from conduct that is (or may be perceived to be) harmful to themselves or other Participants.
Violations of this Code include but are not limited to the following:
- Discriminatory conduct based on race, gender, gender identity or expression, age, sex, appearance, sexual orientation, disability, national origin, ethnicity, political affiliation, religion, marital status, veteran status, or any other characteristic protected by applicable law;
- Harassment, meaning unwelcome, offensive, or demeaning verbal comments, visual displays, or physical contact directed at any Participant, including conduct, comments or images that a person would reasonably find offensive;
- Sexual harassment, meaning unwelcome, unsolicited, and unreciprocated sexual advances, requests for sexual favors, and other verbal and physical conduct, comments, or gestures of a sexual nature that has or that might reasonably be expected to be perceived to offend, humiliate, or intimidate another person;
- Deliberate intimidation, threatening, stalking, following, or non-consensual photography or recording;
- Exhibiting behavior that is unruly, disruptive, or unprofessional, or that endangers the health or safety of yourself or others, including alcohol over-intoxication or overindulgence;
- Actual or threatened pushing, shoving, or use of any physical force or weapon of any kind against any person;
- Possession of prohibited items, including, but not limited to, weapons of any kind (including firearms, knives, or other items that may cause harm to others), illegal drugs, or alcohol not served by venue personnel, Sponsor staff, or officially designated Sponsor partners.
- Destruction, theft, dismantlement, defacement, abuse or intentional misuse of Event venues, property, equipment, signage or supplies;
- Failure to comply with directions of Event leaders and organizers, venue personnel, or staff regarding Event operations;
- Retaliation or threat of retaliation against Participants for reporting activity that they reasonably believed to be in violation of this Code; and
- Knowingly and falsely reporting violations of this Code in bad faith.
This Code is not intended to be all inclusive, and it is likely there will be conduct issues that it does not specifically address. In that event, as in all others, Participants are expected to follow the direction of Sponsor staff who will take appropriate action to ensure the wellbeing of Participants.
Impermissible Political Activities
The Event is focused on engaging Participants on topics related t issue advocacy and education activity. It is not intended to serve as a forum for the discussion of strategies to influence elections or the support or opposition of candidates or political parties.
By attending the Event, Participants agree not to engage in any behaviors which may constitute unlawful coordination under applicable campaign finance laws. You agree, therefore, that You will not discuss or share with any other Participant any nonpublic information you may have about the plans, projects, needs or activities of a candidate or political party, including but not limited to polling, research, or strategic information regarding advertising (including audience selection, content, timing, or media buys) and that You will abide by any additional anti-coordination guidelines that may be distributed to Participants at the Event.
Consequences of Participant Engagement in Prohibited Conduct
Sponsor has a zero-tolerance policy regarding prohibited conduct. Participants asked to stop any inappropriate conduct are expected to comply immediately. Sponsors, in its sole discretion, will determine the nature of the Participant conduct that warrants corrective action as well as the corrective action to be taken. Corrective action may take any of the following forms: verbal warning; expulsion from the Event without a refund; bar from future Events; and/or notifying appropriate authorities. The decision of Sponsor is final.
Reporting Unacceptable Behavior
Violations of this Code are taken seriously. Please promptly report any concerns about inappropriate conduct to Sponsor staff present at the Event or to Max Nacheman, Counsel at The Hub Project, at mnacheman@thehubproject.org or 215-356-3248. Share as much information as you can to help us make a thorough investigation of the incident. Sponsor will investigate all incidents reported at the Event with discretion.
Sponsor asks all individuals involved in the reporting process to maintain strict confidentiality. To protect all parties involved, Sponsor will generally not make any detailed public statements about Code incidents, and Sponsor will make reasonable efforts to maintain the confidentiality of relevant materials. However, Sponsor may disclose case-related materials or information in response to legal process, when already publicly known, when necessary for its investigation, or when Sponsor leadership otherwise determines disclosure is in the best interests of Sponsor.
If you or someone else is in immediate danger, or if you see something suspicious or would like to report a security issue or emergency, please contact Event venue security or local law enforcement.
Accommodations

Publicity
Portions of the Event may be photographed, videotaped, or otherwise recorded. You authorize Sponsors and any person or entity acting on their behalf to record photographs or other portraits or likenesses of You on videotape, audiotape, film, photograph or any other medium (the “Recordings”). You irrevocably grant to Sponsor, Sponsor affiliates, and any person or entity acting under on Sponsor’s behalf or authority a license to use, copy, modify, adapt, distribute, publish, display, exhibit and otherwise use, in whole or in part, the Recordings, and your name and/or handle, for any non-commercial purpose whatsoever, in any and all media (whether now known or hereafter devised).
Release and Waiver of Liability and Assumption of Risk
YOU AGREE AND ACKNOWLEDGE THAT YOUR ATTENDANCE AND PARTICIPATION IN, AND ANY TRAVEL FOR THE EVENT, IS COMPLETELY VOLUNTARY. You further agree and acknowledge that Sponsor cannot guarantee an environment free of physical hazards, third party harm, or communicable diseases, including COVID-19.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU (FOR YOURSELF, YOUR HEIRS, EXECUTORS, AND ASSIGNS) WAIVE, RELEASE, AND FOREVER DISCHARGE SPONSOR AND SPONSOR AFFILIATES AND THEIR RESPECTIVE PAST, CURRENT, OR FUTURE OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AGENTS, AND OTHER REPRESENTATIVES (INDIVIDUALLY AND COLLECTIVELY, THE “RELEASED PARTIES”) ARISING FROM OR RELATED TO THE EVENT, EVEN IF RESULTING FROM THE ACTS, OMISSIONS, OR NEGLIGENCE OF SPONSOR OR ANY OF THE RELEASED PARTIES. YOU COVENANT NOT TO SUE ANY OF THE RELEASED PARTIES FOR ANY OF THE CLAIMS THAT YOU HAVE WAIVED, RELEASED, OR DISCHARGED.
Miscellaneous
This Agreement constitutes the entire agreement with respect to its subject matter and shall be governed by and construed in accordance with the law of the jurisdiction in which the Event occurs. No waiver of any provision of this Agreement shall be effective unless in writing and signed by Sponsor. Nothing contained in any purchase order, terms and conditions, or invoice provided by you will in any way modify or add any additional terms and conditions to this Agreement. If any part of this Agreement is declared unenforceable or invalid, the remainder will continue to be valid and enforceable. You represent and warrant that You are over the age of eighteen (18) years (or will be on the date of the Event).
Sponsor may change this Agreement by posting a revised version at https://thehubproject.org/trending-up-participation-agreement/ or any other applicable website and such updates will be effective upon posting. Your attendance at or participation in any Event following any changes to this Agreement will constitute your acceptance of those changes, as applicable.
If You do not agree to these terms and conditions of this Agreement, as may be amended, please do not attend or participate in the Event.
